Unlike married heterosexual couples,under Florida law, a same-sex partner does not get the automatic right to obtain private information or make important medical decisions when his or her partner is incapacitated. A same-sex partner also does not automatically inherit assets upon his or her partner's death like a heterosexual spouse would. Proper and good planning is essential to ensure these rights.

We use documents such as durable powers of attorney, HIPPA waivers and health care proxies to guarantee that our client's partner is afforded access to financial and medical information and has decision making powers in times of crisis. If one partner is the biological parent of a child, the other partner may have no legal rights to that child if the biological parent passes away. In appropriate circumstances, we can set up a standby guardianship, appointing a partner as the standby guardian before an emergency strikes.
